Terms of service

The rules for using Park & Dash: your account, parking fees, your wallet and what to do if something goes wrong.

01About these terms

These terms are an agreement between you and Inoseek (“Inoseek”, “we”, “us”) for the Park & Dash app, website and parking service (the “Service”). By creating an account or using the Service you agree to them. If you do not agree, please do not use the Service.

Please also read our Privacy Policy, which explains how we handle your information.

02What the Service does

Park & Dash lets you register your car, have a parking session start and end automatically when your number plate is read at the gate of a participating parking lot, and pay the parking fee from a wallet you top up with M-Pesa. You can follow your sessions, receipts, alerts and support requests in the app.

03Your account

  • You must be 18 or older and able to enter a binding agreement.
  • Give us accurate information (name, email, phone number) and keep it up to date.
  • Your account is for you alone. Keep your password private, and tell us straight away if you think someone else has used your account.
  • We may ask you to confirm your email and your phone number by a code before you can use parts of the Service.
  • You are responsible for what happens under your account.

04Your cars and number plates

Only register a car that you own or are allowed to use, and enter its number plate correctly. A car you register is recognised at the gate and its parking is charged to your wallet. You can pause or remove a car in the app. If your car is parked while it is not registered, the parking fee is still due and can be collected by the lot’s staff.

05Parking, fees and payment

  • Each parking lot sets its own rates. The rate and the running fee are shown in the app during your session.
  • A session starts when the lot’s camera records your car entering and ends when it records your car leaving. The fee is worked out from those times.
  • When your session ends we take the fee from your wallet. If your balance is too low we ask you to pay the rest with M-Pesa, and the session stays open for payment until you do.
  • A parking fee that is not paid remains owed to the lot and may be collected by the lot’s staff.
  • You will find a receipt for every session in the app.

06Your wallet and top-ups

  • You add money to your wallet with M-Pesa. Safaricom’s own terms and charges apply to M-Pesa.
  • The wallet is a prepaid balance used to pay parking fees through Park & Dash. It is not a bank account and does not earn interest.
  • Every top-up, charge and refund is recorded in your wallet history.
  • Money in your wallet that you no longer want can be requested back by contacting us.

07Mistakes, disputes and refunds

Number plate reading can occasionally be wrong. If you think you were charged by mistake, charged twice or charged for a car that was not yours, open a support request or a refund request in the app. We will look into it and, where a charge was wrong, refund it to your wallet.

If we make a mistake that costs you money, we will correct it. We may also correct errors in your favour or ours when we find them.

08What you must not do

  • Use the Service for anything unlawful, or to deceive or defraud anyone.
  • Register a number plate that is not yours to register, or give false details.
  • Try to avoid a parking fee, tamper with a camera or gate, or interfere with how the Service works.
  • Attempt to break into, overload or reverse-engineer the Service, or access another person’s account.
  • Misuse the support, alert or refund features.

09Parking lots and our role

Parking lots are run by their owners and operators, not by Inoseek. Each lot’s own rules, such as opening hours, speed limits and where you may park, apply while you are there. We provide the software that recognises your car and handles the payment.

Inoseek does not look after your vehicle or what is inside it, and the lot operator is responsible for the premises. Please raise any problem with a vehicle or a premises directly with the operator.

10Availability and changes

We work to keep the Service running, but it may sometimes be unavailable because of maintenance, a problem at a lot, a network or phone-company outage, or something beyond our control. We may change, add or remove features, and we will tell you about changes that matter.

11Notifications and messages

We send notifications, text messages and emails about your parking, payments, alerts and account. You can turn off notifications in the app, but some messages (such as a verification code or a payment that needs your action) are part of how the Service works.

12Our property

The Park & Dash name, logo, app and software belong to Inoseek or its licensors. You may use them only to use the Service. Your information remains yours; you allow us to use it as described in the Privacy Policy to provide the Service.

13Ending your use

You can stop using the Service at any time and ask us to delete your account (see how to delete your account). Any fee you already owe stays payable.

We may suspend or close an account that breaks these terms, is used for fraud, or puts others at risk. Where we reasonably can, we will tell you why and give you a chance to respond.

14Our responsibility

The Service is provided “as is” and “as available”. To the extent the law allows, Inoseek is not liable for losses that are not a direct result of our breach of these terms, for loss of profit, or for events outside our reasonable control. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud, and nothing affects your rights under Kenyan consumer protection law.

15Governing law

These terms are governed by the laws of Kenya. We will always try to settle a problem with you directly first; if we cannot, the courts of Kenya have jurisdiction.

16Changes to these terms

We may update these terms. We will post the new version here with a new “updated” date, and tell you in the app or by email about important changes. If you keep using the Service after a change takes effect, you accept the new terms.
